The compliance disaster nobody talks about

ASCI's half-yearly report for FY 2025–26 reviewed 1,609 influencer advertisements and found 97.3% non-compliant — overwhelmingly for missing or buried disclosure labels. That's not a fringe problem; it's the industry default. And since both the advertiser and the influencer are responsible under the guidelines (with regulators like CCPA able to impose penalties in egregious cases), 'the brand never told me to add #ad' is not a defence.

What proper disclosure looks like

The rules are specific about prominence, not just presence:

  • Use a permitted label: #ad, #advertisement, #sponsored, #collaboration/#collab, #partnership, #employee or #free — in the first two lines of the caption, before 'more'.
  • Video content needs the label on the video itself, not only the caption: momentary for clips under 15 seconds, longer for longer videos; audio disclosure for audio-first formats.
  • Stories need the label on every story frame that's part of the promotion.
  • Disclosure applies to barter too — a free product in exchange for coverage is material connection, full stop.

Health and finance: the qualified-creator rules

Since ASCI's 2025 addendum, influencers making health or nutrition claims need relevant qualifications (doctor, nutritionist, certified fitness professional), and financial advice content requires SEBI-registration for investment advice. Briefs that push unqualified creators toward medical or return-promising claims put both parties at risk of takedowns and penalties.
